What death benefits does workers’ compensation provide?

Among the benefits that are available to the dependents of a worker who was killed at work or who died due to an occupational disease include wage-replacement payments and funeral expenses. In New Jersey, the maximum amount of funeral expenses that can be recovered is $3,500.

In addition, family members can receive payments on a weekly basis according to the deceased worker’s average weekly compensation at the time of death, up to a certain amount. In New Jersey, wage-replacement payments represent 70 percent of the weekly pay for the deceased worker. Usually, dependents who are qualified to receive a workers’ compensation death benefit are the workers’ spouse and minor-age children.
